Public Notice No. 002/2026 from the Municipality of Maceió opened a new direct settlement round for holders of precatórios linked to the Court of Justice of Alagoas, the Federal Regional Court of the 5th Region and the Regional Labor Court of the 19th Region. Applications are accepted from 8:00 a.m. on September 1 until 10:00 a.m. on September 18, 2026. The official page of the Municipal Attorney General's Office states that R$ 16,577,207.17 is available for the settlements.
For a creditor, the two main points are understanding which discount percentage may apply to the claim and following what happens after the eligibility request is filed. The settlement does not produce automatic payment: it depends on the eligibility review, available funds, the conciliation session and approval by the competent court.
How the 30%, 35% and 40% discounts work
The discount is applied to the updated value of the precatório. The main rule in the public notice combines the registration year with the value of the claim.
| Registration year of the claim | Discount | Value rule |
|---|---|---|
| Up to and including 2023 | 30% | Applies to updated claims below R$ 500,000.00. |
| 2024 | 35% | Applies to updated claims below R$ 500,000.00. |
| 2025 and later years | 40% | This is the bracket established by registration year. |
| Claims above R$ 500,000.00 | 40% | The percentage is mandatory regardless of the registration year. |
For a partial settlement, the public notice says that the amount used to determine the percentage is the total value of the precatório, not only the portion the creditor wants to negotiate. The text also uses the terms “below R$ 500,000.00” and “above R$ 500,000.00.” For an updated claim exactly equal to R$ 500,000.00, the notice does not expressly identify the bracket. In that situation, confirming the interpretation directly with the Precatório Conciliation Chamber before the session is advisable.
The updated value matters because the participating courts update the claims before conciliation. The Municipal Attorney General's FAQ states that the values and statutory deductions are updated by the competent court and presented to the parties at the hearing.
Who can apply and how to file
Holders of precatórios owed by the Municipality of Maceió and originating from TJAL, TRF5 and TRT19 may apply. A representative may also file the request if the power of attorney specifically authorizes settlement and waiver of rights. A creditor who holds more than one precatório must submit a separate request for each one.
The filing may be made in person at the Municipal Attorney General's Office, Rua Dr. Pedro Monteiro, 291, Centro, Maceió, or through the electronic channel indicated by the PGM. For online filing, the official guidance requires a GOV.BR account and PDF files of up to 5 MB each.
The required documents and information include identification and qualification of the creditor, contact phone number and updated address, a specific power of attorney when a representative is involved, the waiver statement required by the notice, official identification with CPF for an individual or corporate documents for a legal entity, updated proof of residence, specific documents for successors or assignees when applicable, and bank details for the holder of the claim.

| Court approval | After signing | The settlement instrument must be approved by the competent court of origin of the precatório. |
| Expected payment | By 12/18/2026 | The public notice presents this date as an estimate. Release of funds is carried out by the competent court after the required procedures. |
How applications are ranked when demand exceeds available funds
Applications are organized and ranked according to the order of preference in the list prepared by the Court of Justice of Alagoas. When there is the same chronological order, the notice provides tie breaking criteria for food related precatórios: first people with a serious illness, then people over 60, and then people with disabilities, while maintaining chronological order within each group.
If the available funds are not enough for all eligible applicants, the list may remain in force during the validity period of the notice, with new amounts deposited into the settlement account used during that period.
Eligibility does not mean guaranteed payment
The public notice expressly states that the eligibility request and even the signing of the settlement instrument, by themselves, do not guarantee receipt. The settlement only takes effect after approval by the competent court and remains subject to available funds. Irregularities involving the creditor's standing or other essential elements of the claim can also prevent the agreement from taking effect.
After the agreement is signed, approval depends on the origin of the precatório. For TJAL precatórios, approval is made by the President of the Court. For TRF5 precatórios, it is made by the federal enforcement court. For TRT19 precatórios, it is made by the President of the Court or by the auxiliary precatório conciliation court, under the rules cited in the public notice.
Funds are released exclusively by the court that issued the precatório, which also processes applicable tax withholdings. Payment under the settlement results in full discharge of the precatório. The creditor may withdraw the proposal until the date of effective payment by filing a petition with the court responsible for approval.
The December 18 payment estimate may change
The schedule in Public Notice No. 002/2026 provides for payment by the court by December 18, 2026. The PGM also explains in its FAQ that the date depends on court approval, issuance of payment orders and other operational procedures performed by the courts. If payment occurs after the scheduled date, the competent court should update the amount through the date of effective payment.
