Temporary incapacity benefit ending while you still cannot return: when to request an extension and what happens next

If you are still unable to work as the benefit end date approaches, learn when to request an INSS extension, what documents to prepare, how the medical assessment works, and what to do after the decision.

If the end date of your temporary incapacity benefit is approaching and you are still unable to return to work or your usual activity, the main step is to request an extension during the final 15 days before the benefit ends. The official INSS service is called “Perícia de Prorrogação e Transformação de Espécie” (Extension and Benefit-Type Assessment) and can be started through Meu INSS; if the system is unavailable, the 135 call center is the indicated channel. The service page was updated in August 2026 and still states this 15-day window.

You do not need to wait for the benefit to end before taking action. In practice, allowing the date to pass can remove the option of using the extension request and may send the case into another administrative route, such as an appeal or a new application, depending on the circumstances. Because this involves both health and social-security rights, this guide is informational and the actual case status should always be checked in Meu INSS, especially when there is a court decision, work-related accident, vocational rehabilitation, or another specific feature of the case.

When to request the extension

The key reference is the Benefit End Date (Data de Cessação do Benefício — DCB), the date on which the benefit is scheduled to end. According to the official INSS extension service, the request must be made during the final 15 days before that date by a person who is still ill and unable to work or perform their usual activity.

This means the request is not an automatic renewal based only on a diagnosis. The central issue remains whether the person is unable to perform their work or usual activity. If you regain your capacity before the scheduled date, INSS rules allow the benefit to be ended at the beneficiary's request through INSS channels.

How to request it through Meu INSS

The official instructions are to sign in to Meu INSS with your CPF and Gov.br password, open the Benefício por Incapacidade area, choose the extension service, and follow the on-screen steps. The request starts online; you do not need to go to an INSS office on your own merely to open the application.

After filing, use “Consultar Pedidos” to track the case. The official service page states an estimated service time of up to 45 days, but this is an administrative estimate, not a guarantee that every case will take exactly that long.

What happens after the request

The official service states that the claimant may be called for a medical assessment during the review. INSS operational rules also provide different paths depending on the waiting time for that assessment. Joint Ordinance PRES/INSS/SRGPS/MPS No. 49, listed in the official INSS legislation database, provides that, outside the exceptions in the rule itself, when the wait for a medical assessment is up to 30 days, the assessment is scheduled; when the wait exceeds 30 days, the rule provides for a 30-day administrative extension without an immediate assessment, limited to two occurrences per claimant under that flow.

This operational rule should not be used to assume a new payment date or return-to-work date on your own. For your case, the controlling information is the status and new date shown in Meu INSS. The process may also differ in exceptional situations or units covered by specific pilot projects.

Documents worth having ready

To start the service, the official page lists identification and CPF. If there is a medical assessment, INSS advises the claimant to bring updated medical records related to the incapacity, such as medical certificates, reports, tests, and other treatment records. The goal is not to submit the largest possible stack of documents, but to show consistently the current condition, its progression, and why returning to the activity is still not possible.

  • official photo ID and CPF;
  • recent medical certificates and reports identifying the health professional;
  • tests that help demonstrate the condition and its progression;
  • information on treatment, medication, therapy, or relevant functional limitations;
  • important earlier records that help establish continuity of the incapacity.

For benefits reviewed through documents, INSS also publishes requirements for medical records under Atestmed, including legibility, claimant identification, issue date, estimated leave period, and identification of the health professional. These requirements help illustrate the expected documentation standard, but an extension request may still be routed to an in-person medical assessment depending on the case.

If a medical assessment is scheduled and you cannot attend

INSS states that the assessment can be rescheduled once, through Meu INSS or the 135 call center, and that the rescheduling deadline is up to 7 days after the scheduled date. The current temporary incapacity benefit page also warns that failure to attend without rescheduling or cancellation may prevent a new benefit application for 30 days.

If hospitalization or being bedridden makes attendance impossible, INSS provides a specific hospital/home assessment procedure: a representative must go to the INSS office at the scheduled date and time with documentation proving the situation, for review by the Federal Medical Assessment service.

What the medical assessment may decide

In an extension case, the assessment is not merely about “adding a few more days.” It evaluates whether the incapacity continues and which benefit is due. The official service states that the assessment may consider both continuation of the temporary benefit and, when applicable, permanent incapacity. In other cases, the conclusion may be that work capacity has been restored and the temporary benefit should end.

Check the result in Meu INSS. Pay particular attention to the new DCB, any new appointment, outstanding requirement, and the content of the decision. Avoid making return-to-work decisions solely from informal messages or an old end date if an extension request is pending.

What if the extension is denied or the deadline has already passed?

INSS states that if the claimant disagrees with a denial or termination and it is no longer possible to request an extension, an administrative appeal may be filed with the Appeals Board. Current INSS guidance indicates a 30-day deadline from the date the claimant becomes aware of the decision.

An appeal is not the same as a new benefit and does not automatically replace a missed extension request. Depending on the reason for termination, the dates, a new incapacity, and the benefit history, the appropriate administrative route may change. If the situation is important or disputed — especially where household income depends on the benefit or there is a conflict between the INSS decision and the treating clinician's assessment — seek qualified Brazilian social-security advice.

Checklist for the final 15 days

  • confirm the Benefit End Date in Meu INSS;
  • if the incapacity continues, file the extension within the final 15-day window;
  • save the protocol and track “Consultar Pedidos”;
  • organize recent medical records;
  • if an assessment is scheduled, confirm date, time, and location/type;
  • if you cannot attend, check rescheduling immediately and stay within the deadline;
  • after the decision, confirm the new DCB or termination before assuming the benefit continues;
  • if there is a denial or termination and extension is no longer available, consider an appeal within the official deadline.
