Father's Day gift delayed: how to charge for delivery, cancel and request refund with proof

If the gift did not arrive on the promised date, gather the evidence and choose: demand delivery, accept an equivalent or cancel with a refund.

When an online purchase was promised delivery before Father's Day and the deadline ended without the product arriving, the consumer does not need to accept new predictions indefinitely. The way forward is to check the deadline offered and inform in writing which solution you chose: receive the product, accept an equivalent or cancel the purchase.

The Consumer Protection Code establishes that sufficiently precise information forms part of the contract. In the event of non-compliance with the offer, article 35 allows the consumer to choose between fulfilling the obligation, another equivalent product or termination with refund of what was paid, in addition to any proven losses and damages.

The commemorative date makes the test even more important. A confirmation saying “delivery by August 9, 2026” is stronger than a generic campaign with references to Father’s Day. If the advertisement mentioned the occasion, but the closing of the order showed a later date, it will be necessary to evaluate all the information presented before purchasing.

First, confirm exactly what was promised

Open the order page and look for the date that appeared at the time of hiring. It can be on the closing screen, in the confirmation email, on the receipt, in the app or in a message sent by the seller.

The Electronic Commerce Decree determines that the offer must inform the full conditions of the contract, including availability, form and delivery time. It also requires the supplier to allow the conservation and reproduction of the contract.

Save, preferably:

  • capture of the ad and product page;
  • cart screen or closing with estimated delivery date;
  • order confirmation;
  • proof of payment;
  • invoice, when already issued;
  • code and tracking history;
  • messages about deadline changes;
  • protocols, emails and customer service conversations;
  • identification of the store, seller and platform;
  • receipts for expenses caused by the delay.

In captures, preserve date, time, order number and page identification. Don't just rely on the history within the app: information may be updated or no longer appear after the complaint is closed.

Choose the solution before getting in touch

A vague complaint, asking only for “action”, facilitates generic responses. Tell us which of the three alternatives you chose.

Require delivery

This option makes sense when the product will still be useful after the anniversary date or when there is no suitable substitute.

Ask for confirmation that the order will be maintained and establish a new objective date. Do not accept open expressions, such as “soon”, “as soon as possible” or “wait for the courier”.

A momentary lack of stock, in itself, does not eliminate the right to fulfill the offer when the product still exists on the market. The Superior Court of Justice has already recognized the possibility of demanding delivery under these conditions.

Use this alternative when:

  • you still want exactly that product;
  • the new deadline continues to be useful;
  • the item has not been discontinued;
  • waiting will not require an immediate replacement purchase.

Accept an equivalent product

The equivalent need not be accepted just because it was suggested by the store. Compare model, purpose, quality, specifications, warranty, accessories and value.

Record that the substitution was accepted to resolve that request. If the product offered is inferior, you can refuse it. If higher, any additional charge depends on your express agreement.

Before accepting, ask in writing:

  • full name and model;
  • relevant characteristics;
  • new delivery deadline;
  • confirmation that there will be no extra cost;
  • maintenance of the invoice and applicable warranty.

Cancel and request a refund

Cancellation is usually the most coherent alternative when the gift has lost its purpose, it was necessary to purchase another item or confidence in the deadline has disappeared.

In this situation, indicate that the reason is non-compliance with the offer and that you have chosen to terminate the contract based on article 35 of the CDC. Request a refund of the total amount paid, including shipping associated with the purchase, and the cancellation of installments not yet charged.

Do not accept store credit, coupons or gift cards as a mandatory replacement for cash. These formats can be negotiated, but should not be imposed when the communicated choice was termination with refund.

Delay is not the same thing as regret

For purchases made outside the commercial establishment, article 49 of the CDC provides for the right to withdraw within seven days, counting from the signature or receipt of the product, as the case may be. This possibility does not depend on defect or delay.

The gift that did not arrive on time involves another reason: non-compliance with the offer. Therefore, it is not correct to say that the consumer can only cancel within seven days of regret. When the promised delivery is not fulfilled, the choice between the alternatives in article 35 arises from the failure to fulfill the offer.

This distinction also matters for the record:

  • regret: withdrawal of a purchase made remotely within the legal period;
  • non-compliance with the offer: product not delivered under the conditions or on the promised date;
  • defect or vice: product received, but with quality, quantity or functioning problems.

Mixing the three reasons can lead the service to apply an inappropriate procedure.

Build a purchase timeline

The timeline transforms several isolated captures into a narrative that can be understood by the store, the marketplace, Procon or the Judiciary.

Use this sequence:

  1. Offer: on [date and time], the product was announced by [value], with delivery indicated for [data].
  2. Payment: on [data], the amount of [total amount] was paid for [payment method].
  3. Deadline: confirmation kept delivery until [promised date].
  4. Movement: on [data], the trace showed [last relevant event].
  5. Delay: the deadline ended on [data] without delivery.
  6. First contact: on [date and time], the [number] protocol was opened.
  7. Response: the company reported [objective summary].
  8. Consumer Choice: in [data], [delivery, equivalent or termination] was required.
  9. Current situation: until [date and time], the solution had not been fulfilled.

Update this timeline after each contact. Avoid deleting previous messages, even when the company presents a new forecast.

Registration template to send to the company

Subject: failure to meet delivery deadline — order [number]

On [purchase date], I purchased product [description], order [number], for the total value of [value]. The offer and order confirmation indicated delivery by [promised date].

The deadline ended without delivery. The tracking records [last information], and previous contacts were made via [numbers] protocols.

In the event of non-compliance with the offer, I choose the following solution provided for in article 35 of the Consumer Protection Code:

[choose only one alternative]

  • fulfillment of the offer, with delivery by [new objective date];
  • supply of the equivalent product [identification or criteria], at no additional cost;
  • termination of the contract, with refund of the total amount paid, including shipping, and cancellation of outstanding installments.

I request confirmation of receipt of this complaint and a written response. I attach proof of the offer, order confirmation, payment, tracking and previous protocols.

Name: [name]
CPF: [inform only on the official channel and when required]
Order: [number]
Date: [data]

In electronic commerce, receipt of the demand must be confirmed by the same means used by the consumer, and Decree No. 7,962/2013 provides for the supplier to respond within five days. This deadline refers to the response to demand; it is not a general five-day deadline for the money to appear in the account or invoice.

Who should receive the complaint

Purchase made directly in store

Send the complaint to the official channel of the store that sold the product. The carrier can help locate the order, but contact with them should not replace the charge made to the supplier responsible for the offer.

If the store simply says to “resolve with the carrier”, respond that the complaint refers to compliance with the purchase contract and ask for a protocol of the chosen solution.

Purchase made on marketplace

Register the complaint both in the order and in the platform's support channel. Identify separately:

  • the advertised seller;
  • the company that received the payment;
  • the platform on which the purchase was completed;
  • who issued the invoice;
  • who promised or updated the deadline;
  • who contracted the delivery.

The platform's liability depends on how it participated in the business. A marketplace that mediates hiring, controls the sales environment or offers its own payment and protection mechanisms should not be confused with a page that only publishes classifieds and lets all negotiations take place outside of it. The STJ has already highlighted that the role effectively played by the platform changes the analysis of responsibility.

Therefore, do not just use the word “marketplace” in the complaint. Show what the platform did: hosted the order, processed the purchase, received commission, defined rules, offered protection, updated delivery or conducted service.

International purchase or shipping

First, find out where the package is. Consult the tracking code on the indicated carrier and check whether the package arrived in Brazil, whether it is under inspection, whether there is a pending requirement or whether it has been returned.

The IRS advises that, when the order does not arrive within the stated deadline, the consumer should contact the website where they made the purchase. The Revenue also clarifies that delivery takes place through the Post Office or a courier company and may depend on customs clearance and other inspection bodies.

Separate the issues:

  • product has not yet arrived in Brazil: contact the seller or platform and record tracking;
  • product is with the carrier: ask the Post Office or the courier company for information;
  • there is a tax requirement: check the official channel and the deadline to present documents or pay taxes;
  • import was not authorized or is being returned: request the platform to cancel and refund according to the purchase conditions;
  • taxes were paid, but the order was not received: separately evaluate the tax refund and the refund of the product, shipping and insurance.

The IRS informs that, in certain situations of return or seizure, the recipient may request a refund of taxes paid; The value of the goods, shipping and insurance is dealt with in the contractual relationship between buyer and seller.

Charging tends to be more difficult when the contracting took place directly with a foreign website without an establishment or representative in Brazil. Procon-SP recommends checking in advance the existence of national representation and warns of the practical limitations of protection on foreign websites.

How to request a refund according to payment

Credit card

Ask for the cancellation of future installments, the refund of those already paid and proof that the refund was requested. The display on the invoice may depend on the closing date and the administrator's procedure.

If the store does not resolve the issue, disputing the transaction with the card issuer can be used as an additional channel, in accordance with the institution's contractual rules. This does not mean that the payment company is automatically responsible for non-delivery when it has only processed a purchase made on another website and the financial service has not failed. The STJ reaffirmed this distinction in a decision released in July 2026.

Pix, bank slip or debit

Enter the necessary data for refund only within the official channel and confirm account ownership. Ask for proof of the transfer and do not send a password, authentication code or access to the banking application.

Be wary of agents who demand payment of a “release fee”, application installation or screen sharing to return the money.

Platform balance, voucher or wallet

If the original payment came from a card, Pix or bank account, register that you do not agree with the mandatory conversion into internal credit. If you accept the balance for convenience, keep the message that informs the value, validity and conditions of use.

The product arrived after cancellation

If delivery occurs after you have communicated termination, do not use the product as if the purchase remained valid.

When possible, refuse delivery and record the incident. If someone else receives it or the package is left at the address, keep the item unused, photograph the packaging and ask for return instructions through the official channel.

Do not discard the product, do not resell it and do not keep the merchandise and the refund simultaneously. Documentation must demonstrate that you made the item available for return.

When to take the complaint to another channel

If the store or platform does not meet the chosen solution, use the already organized timeline and attachments.

Consumidor.gov.br

Check if the company participates in the platform. The service is free, requires a Gov.br account and allows you to attach an invoice, proof of payment, contract, protocols and other documents.

According to guidance published by the Ministry of Justice and Public Security on July 10, 2026, the registered company has up to ten days to submit a response after registration.

In the description, state at the beginning:

  • order number;
  • promised deadline;
  • date on which the delay began;
  • chosen solution;
  • amount that must be refunded, when applicable;
  • protocols already open.

Procon

Look for Procon in your state or municipality when the response does not resolve the problem, when the company is not on Consumidor.gov.br or when it is difficult to identify the person responsible.

Take the chronology, identification of suppliers, receipts and a copy of the complaint with the chosen solution.

Special Civil Court

In less complex conflicts, it may be possible to appeal to the Special Civil Court. Law No. 9,099/1995 establishes jurisdiction for cases up to 40 minimum wages. Up to 20 minimum wages, assistance by a lawyer is optional in the first instance; above this value, it is mandatory. Service and petition rules vary depending on the local court.

Before filing, organize:

  • correct identification of each company;
  • proof of the promised deadline;
  • proof of payment;
  • complaint and protocols;
  • response or lack of response;
  • proof of alleged material losses;
  • exact order value.

Additional losses need to be demonstrated

Article 35 admits losses and damages, but this does not transform every delay into automatic compensation.

If it was necessary to purchase another gift, keep the receipt and record why the new purchase was a result of the delay. If there was a difference in price, travel or other expenses, keep the receipts.

Moral damages depend on the specific circumstances. Simple contractual frustration does not guarantee compensation; it is necessary to demonstrate a relevant repercussion beyond common non-compliance. The STJ has already ruled out automatic compensation in cases of failure to deliver merchandise intended as a gift.

What to do now

Open the order, capture the promised date and set up the timeline before starting a new conversation with customer service.

Then, choose a single solution: delivery, equivalent or cancellation. Send the model through the official channel, save the protocol and update the registration until the product is delivered or the refund is completed.
