As of September 8, 2026, the transition rule for the FGTS Birthday Withdrawal (Saque-Aniversário) advance remains in force: through October 31, 2026, the rights to up to five annual withdrawals may be assigned or transferred as collateral; starting November 1, 2026, the maximum falls to up to three annual withdrawals. The cap per annual withdrawal remains between R$100 and R$500. This creates an aggregate regulatory ceiling of up to R$2,500 before the change and up to R$1,500 afterward, if every available annual entitlement reaches the maximum amount.
But “up to five” does not mean every worker can obtain five installments now. The number actually available depends on which future annual entitlements are still free, the FGTS balance, any outstanding advance and compliance with the other conditions. The official FGTS Birthday Withdrawal page and CCFGTS Resolution No. 1,130/2025 published in Brazil's Federal Official Gazette are the main references for the change.
What changes on October 31 and November 1, 2026
| Rule | Through Oct. 31, 2026 | From Nov. 1, 2026 |
|---|---|---|
| Maximum number of annual withdrawals assigned/advanced | Up to 5 | Up to 3 |
| Minimum amount per annual withdrawal | R$100 | R$100 |
| Maximum amount per annual withdrawal | R$500 | R$500 |
| Theoretical maximum total if every entitlement reaches the cap | Up to R$2,500 | Up to R$1,500 |
| Credit operations per annual entitlement | One operation per annual Birthday Withdrawal | One operation per annual Birthday Withdrawal |
| New operation when an advance on the next withdrawal is still outstanding | Subject to settlement of the outstanding advance tied to the next Birthday Withdrawal | Same condition |
The November change reduces the maximum number of future rights that can be used as collateral in a new advance. The R$100-to-R$500 limits per annual withdrawal and the one-operation-per-entitlement rule remain in place.
Who can still advance up to five withdrawals before October 31
In general terms, a worker is still within the up-to-five window if the transaction can be completed by October 31, 2026 and there are future annual entitlements available. The operational conditions applicable to the worker and the chosen financial institution still have to be met.
- Be enrolled in the Birthday Withdrawal system. The advance uses future annual withdrawals as collateral.
- Meet the 90-day waiting period before authorizing balance consultation and blocking. Under the current rule, authorization to the financial institution may only be granted after at least 90 days have elapsed since the Birthday Withdrawal option became effective.
- Have sufficient FGTS balance and available future withdrawals. The institution's system and the FGTS service show which annual entitlements can be assigned.
- Do not try to use two operations for the same annual entitlement. Each annual Birthday Withdrawal may be linked to only one credit operation.
- Observe the restriction on a new transaction. A new operation is conditional on settlement of the outstanding advance tied to the next Birthday Withdrawal.
For that reason, the October 31 deadline should not be read as a promise of five installments for everyone. It defines the maximum allowed under the transition rule.
Birthday-month examples: how the rule works in practice
Official examples help show that the birthday month affects the annual entitlement and the timing of the transfer, but does not by itself create a right to five installments.
| Example | Situation | What it shows |
|---|---|---|
| December birthday | With no transaction in the period described by the official example, an advance completed by Oct. 31, 2026 can cover 2026, 2027, 2028, 2029 and 2030. From Nov. 1, 2026, the same example falls to 2026, 2027 and 2028. | The transaction date before or after the cutoff changes the maximum number of annual entitlements that may be assigned. |
| April birthday | In an official example, an advance taken in December 2025 covered 2026 through 2030. The transfer related to the next withdrawal occurs in the birthday month and only after the applicable settlement is a new annual entitlement opened for another operation. | Paying with the worker's own funds does not necessarily allow a new operation to bypass the settlement schedule for the next Birthday Withdrawal. |
| March birthday | In an official example, an operation tied to the March 2026 Birthday Withdrawal prevents a second operation on that same annual entitlement, even if new FGTS deposits are made and the earlier amount was below R$500. | The restriction applies by annual entitlement, not only by amount in reais. |
For any other birthday month, the logic is the same: what matters is which future annual withdrawals are still shown as available in the system when the transaction is made. The CAIXA FGTS withdrawal page and the FGTS app are the appropriate channels for checking the actual situation.
What is blocked in the FGTS when an advance is taken
The advance is a loan secured by future Birthday Withdrawal rights. According to the FGTS, the amount blocked in the account is not simply the net amount the worker receives. The system blocks the base balance needed to generate, under the statutory Birthday Withdrawal formula, the amount pledged as collateral, excluding the termination fine.
This matters because “receiving R$500 as an advance” and “having R$500 blocked” are not necessarily the same thing. The blocking may affect the availability of the balance for other permitted uses while the operation remains outstanding.
The 90-day waiting period can prevent a last-minute transaction
Workers who have not yet enrolled in the Birthday Withdrawal system need to watch the calendar closely. The current rule requires at least 90 days between the start of the option and the authorization allowing the institution to consult the balance and block it as collateral. Therefore, enrolling close to October 31, 2026 does not automatically provide access to the five-withdrawal window.
There is, however, a useful distinction between simulating and contracting: the FGTS itself says a worker may simulate the advance with an authorized institution without first opting into the Birthday Withdrawal system. That allows proposals to be compared before changing the withdrawal system.
Is it worth advancing just to use the five-installment window?
The deadline may matter, but it should not be the only reason for the decision. The advance converts future FGTS rights into collateral for credit received today. Before signing, compare the value of immediate cash with the cost and with the loss of flexibility over future withdrawals.
- Compare the Total Effective Cost (CET), not just the interest rate. Brazil's Central Bank explains that CET combines interest, fees, taxes and other expenses and is the proper measure for comparing offers. See the official guidance at Loans and Financing, Banco Central do Brasil.
- Check the net amount that will actually reach your account. The number of annual withdrawals assigned does not, by itself, tell you how much cash you will receive.
- Compare alternatives. Using the advance to replace expensive debt has a different rationale from taking credit for consumption that could be postponed.
- Consider the effect of choosing Birthday Withdrawal. While this system is in force, a worker dismissed without cause may withdraw the termination fine, but not the full FGTS balance because of the dismissal, except under other withdrawal grounds provided by law.
- Remember the return to the Termination Withdrawal system. The change can only take effect when there is no outstanding advance and, after the request, becomes effective on the first day of the 25th month that follows.
Checklist before contracting by October 31
- Check in the FGTS app whether you are enrolled in Birthday Withdrawal and for how long.
- Confirm whether the 90-day waiting period for authorization has ended.
- Check which future annual entitlements are actually available.
- Verify whether an outstanding advance blocks a new operation tied to the next withdrawal.
- Run simulations with more than one authorized institution.
- Compare CET, the net amount released and settlement conditions.
- Read the contract and confirm how many annual withdrawals will be assigned.
- Consider the effect of Birthday Withdrawal on a possible dismissal and on a future return to the Termination Withdrawal system.
In short: workers who already meet the conditions and have free future entitlements may still enter an advance involving up to five annual withdrawals through October 31, 2026. Starting November 1, 2026, new operations are limited to up to three. The cutoff is real, but the decision should be based on the cost of credit, the net amount received, available annual entitlements and the effect of remaining in the Birthday Withdrawal system.
