Consumidor.gov.br, Procon or regulator: where to take each type of complaint?

Consumidor.gov.br, Procon and regulatory agencies have different functions. See which channel to use depending on the desired result and when it may be necessary to go to court.

Choosing where to complain doesn't just depend on the type of company. It mainly depends on the result you want to obtain.

If the priority is to open a direct and documented negotiation with a company that participates in the platform, Consumidor.gov.br may be the simplest path. If you need the action of a consumer protection body, including the possibility of inspection and administrative proceedings, Procon has another function. A regulatory agency can be especially relevant when the problem involves specific rules for sectors such as telecommunications, supplementary healthcare, electricity or financial services.

And there is an important caveat: none of these channels should be automatically treated as a substitute for the Judiciary when the objective requires a judicial decision, such as sentencing to pay compensation. Consumidor.gov.br itself informs that its platform does not replace Procons, Defenders or Courts, and Procons clarify that they do not have the competence to grant compensation for moral or material damages.

What changes from one channel to another

The most useful comparison is not to ask which channel is “better,” but what each was created to do.

Channel It makes more sense when What it can produce Main limit
Consumidor.gov.br Do you want to negotiate directly with a registered company Formal response from the company and attempt to resolve the conflict via the platform It is not an administrative process and depends on the company participating in the service
Procon Do you want guidance, intermediation and administrative action in consumer protection Negotiation, notification, conciliation, inspection, administrative process and possible sanction Does not replace a court decision or grant compensation for damages
RegulatorThe problem involves a specific obligation or rule of a regulated sector The effect depends on the regulator: referral to the company, mediation, monitoring, inspection or subsidy to supervision There is no single model; some regulators do not resolve individual conflicts

The difference between the first two channels is particularly clear. Consumidor.gov.br defines itself as a public service for direct dialogue between consumers and companies and expressly states that does not constitute an administrative procedure. The registered company receives the complaint and has up to ten days to respond; Afterwards, the consumer can comment and evaluate the solution.

Procon, on the other hand, is part of the consumer protection administrative structure. Decree No. 2,181/1997 assigns functions to state, district and municipal consumer protection bodies such as responding to complaints, monitoring consumer relations and acting in administrative processes. The standards also provide for competence to investigate infractions and apply administrative sanctions within the respective area of activity.

When to choose Consumidor.gov.br

Consumidor.gov.br tends to be a good first choice when there is a well-defined individual problem and you expect the company itself to be able to resolve it: cancel a charge, correct a registration, deliver a product, clarify a contract, return a certain amount or present a definitive answer, for example.

Before registering the complaint, it is necessary to check whether the company participates in the platform. Adherence is not universal. The service itself informs that interested companies formally join and undertake to analyze complaints; If the company is not registered, it is not possible to file a lawsuit against it in that environment.

This channel is also useful when you want to create an organized history of the conflict. The complaint, the company's response and its evaluation are recorded in the platform's flow. This does not mean that the record alone legally proves everything that occurred, but it helps document what was requested and how the company responded.

In practice, the complaint works best when it ends with an objective request. “I want a solution” says little. “I request the cancellation of the charge of R$

If the company does not participate, does not respond satisfactorily or the case requires administrative action that goes beyond direct negotiation, it is time to consider another channel.

When Procon adds something that the platform does not offer

Procon is not just another inbox to send the same message.

In addition to providing guidance and attempting to reach a solution between consumer and supplier, Procons can exercise supervision, initiate administrative proceedings and apply sanctions for infringements of consumer protection rules, subject to their competencies. Decree No. 2,181/1997 expressly provides for these functions, and bodies such as Procon-ES describe activities in negotiation, conciliation, inspection and application of administrative sanctions.

This makes Procon especially pertinent when there is evidence of a consumer practice that deserves administrative analysis, when the company is not on Consumidor.gov.br or when previous attempts at negotiation have not resolved the problem.

It may also make sense to look for Procon when the consumer needs guidance in structuring the complaint or understanding which documents to present. The specific procedure, available channels and required documents vary between state and municipal Procons, so it is necessary to consult the body that will handle the case.

The possibility of sanctions, however, should not be confused with compensation to the consumer. An administrative fine imposed on a supplier is not equivalent to a court order to pay moral or material damages to the complainant. Procon-ES, for example, expressly informs that it does not grant this type of compensation and that the consumer can appeal to the Judiciary when the issue is not resolved at the administrative level.

When to contact the regulatory agency

Here is the point at which a simple rule like “regulated company = complain to the regulator” starts to fail.

Each agency has its own competencies, procedures and effects. Therefore, before opening a complaint, you need to know what that regulator actually does with an individual demand.

In telecommunications, for example, Anatel advises consumers to complain to the operator first and, if necessary, turn to the company's ombudsman. If the problem persists, the complaint can be registered with Anatel Consumidor. The Agency forwards the demand to the provider, who has ten calendar days to respond. Anatel itself explains that it is the operator, and not the Agency, who responds directly to the consumer; at the same time, complaints are used by the Agency in its monitoring of the sector.

In health plans, the ANS has a different mechanism. After the beneficiary seeks the operator, a complaint to the Agency may generate the Preliminary Intermediation Notification, the NIP. According to the page updated by ANS on June 30, 2026, the operator has five working days to respond to assistance demands, related to plan coverage, and ten working days for non-assistance demands. Unresolved cases may also have effects on the Agency's supervision and indicators, according to the applicable rules.

In the electricity sector, ANEEL recommends a similar sequence: first the distributor, then the distributor's ombudsman and, if the problem persists, the Agency's channels. ANEEL itself also allows certain conflicts with distributors to be handled by Consumidor.gov.br, showing that the paths can complement each other.

In the financial system, the difference is decisive. The Central Bank accepts complaints against supervised institutions, but states that it does not resolve individual cases. The complaint is responded to by the institution and also serves as support for BC supervision. For an unresolved individual problem, the Central Bank itself advises the consumer to consider, among other options, Procon and Consumidor.gov.br.

Susep offers yet another example of how the demand objective changes the channel. In guidelines updated in April 2026, the authority recommends Consumidor.gov.br for certain individual conflicts with insurance companies and indicates a complaint to Susep when there is a situation that may require administrative measures against a supervised company.

Therefore, “complaining to the regulator” is only a complete strategy after verifying two things: whether the matter really belongs to the competence of that body and what consequences the procedure may produce.

Choose the result you want to get

A practical way to decide is to start at the end.

If the objective is to quickly obtain a response or proposal from the company, first check if it participates in Consumidor.gov.br. The channel was designed precisely for this direct dialogue and records the response given by the company.

If you want to initiate an administrative consumer protection body, including because negotiations have not progressed or there is a possible violation of consumer standards, Procon gains relevance.

If the problem depends on a technical rule or specific obligation of a regulated sector, consult the competent agency's procedure. Anatel, ANS, ANEEL and Banco Central show that the simple label “regulatory agency” hides very different mechanisms.

And if the desired outcome requires an order that these channels cannot grant — especially a court order to pay compensation — it may be necessary to evaluate the appropriate legal route. The use of Consumidor.gov.br or Procon does not, in itself, prevent the consumer from subsequently seeking available legal remedies.

The claim is stronger when the request and the evidence match

Regardless of the channel, record the problem so that a third person can understand what happened without reconstructing the story themselves.

Separate, as appropriate:

  • proof of purchase or contracting;
  • offer, advertisement or conditions presented;
  • agreement and applicable terms;
  • invoices and proof of payment;
  • SAC and ombudsman protocols;
  • messages, emails and responses from the company;
  • records that show relevant dates and values;
  • a specific final order compatible with the problem.

In sectors where complaints to the regulator depend on previous contacts, keeping protocols is even more important. Anatel, ANS and ANEEL expressly advise the consumer to first contact the company or its ombudsman in certain situations and to keep or inform these records when proceeding to the agency.

The best complaint history is not the longest. It is one in which dates, documents, previous attempts and the final request allow us to clearly see the problem and the expected result.
